Before You Enter

  • Confirm that your Washington residence is included and note when the sponsor measures residency.
  • Read the sponsor’s age requirement and any prize-specific restrictions.
  • Use the official entry method and follow any free-entry instructions exactly.
  • Record limits per person, household, email address, social account, or entry period. Extra entries can cause disqualification.
  • Convert the deadline from the time zone stated in the rules. Do not assume the sponsor uses your local time.

Understand Washington’s Free-Entry Rule

RCW 9.46.0356 authorizes promotional contests of chance in which prize and chance are present but consideration is not. It says an eligible person cannot be required to pay the promoter or buy something to participate. Outside direct-mail solicitations, a sponsor may give additional entries with a purchase only when it also provides an alternate entry method that requires no consideration.

The statute defines consideration as something of monetary value required to be paid to the promoter or sponsor. Visiting a business, placing or answering a phone call, completing an entry form or customer survey, or providing a stamped self-addressed envelope do not count as consideration under that definition. Follow the sponsor’s stated free route exactly; this summary is general information, not legal advice.

Read Washington Prize Offers Carefully

Washington’s promotional advertising of prizes law applies to defined written offers delivered by hand, mail, or another print medium that offer goods, services, or property as part of a promotion based on a representation that a person has been or will be awarded a prize.

For an offer covered by RCW 19.170.030, the promoter and sponsor must be identified, prize values must be stated, and chance-based offers must disclose odds. Sales-presentation requirements and prize restrictions also require disclosure. The law says an item cannot be called a free prize or gift when the recipient must spend money to receive or meaningfully use it. Because the chapter has a defined scope, do not assume every sweepstakes page or winner email is governed by each requirement.

Plan for Federal Taxes and Avoid Scams

IRS Publication 525 on prizes and awards says prizes generally must be included in federal income, including the fair market value of goods or services. The Washington Department of Revenue says Washington currently has no individual income tax. That does not remove federal tax or tax obligations in another jurisdiction, and state policy can change. Keep the award notice, valuation, and tax forms, and seek qualified advice for a substantial prize.

The Washington Attorney General’s sweepstakes scam guidance warns about supposed prizes that require a fee or merchandise purchase. Do not use contact details supplied in an unexpected notice. Find the sponsor independently, compare the message with the rules you saved, and refuse payment demands for releasing a prize.
