New Jersey Sweepstakes Rules and Prize Taxes
New Jersey P.L. 2025, chapter 128, approved August 15, 2025 and effective immediately, addresses sweepstakes in which a person present in New Jersey may participate by paying or offering something of value. Among its conditions for a lawful sweepstakes are a no-cost entry method, equal odds for paid and free methods, and clear disclosure of the rules, prizes, and odds—or disclosure that entries are unlimited. This is a useful reason to read the full rules and avoid an offer that hides its free route or gives purchasers better odds.
The same law says no person under 18 may claim a sweepstakes prize worth more than $1,000 without a parent or guardian’s consent. That provision does not make every promotion open to everyone under 18; the sponsor may set a higher minimum age, and its official rules still determine who may enter.
The law also states that the value of a cash or merchandise sweepstakes prize is income for New Jersey income-tax purposes. Federally, the IRS includes prizes and awards among potentially taxable income, including income paid in property, goods, or services. Do not assume a noncash prize is tax-free. The Federal Trade Commission’s prize-scam guidance warns that demands to pay fees or provide financial information to claim a supposed prize are scam signals. Do not trust contact details supplied in a suspicious message; independently find the sponsor’s official website and verify the promotion.
