Start with opportunities listed for the United States, then check whether the rules include Maryland specifically. A national promotion can still exclude certain states, limit entry to a store area or delivery zone, or set an age requirement higher than Maryland’s general age of majority. Maryland’s age of majority is 18, but a sponsor can set a different eligible age in its rules.
Maryland law has a consumer-protection rule for prize notifications in advertising. In general, a business may not tell someone they have won, been selected, or are eligible for something of value if the person must buy goods or services, pay to participate, or submit to a sales promotion effort; the law includes specific exceptions. Before You Enter or Claim a Prize
- Confirm that Maryland residents are included. “U.S. residents” often includes Maryland, but the sponsor’s rules control.
- Check the minimum age, any parent or guardian requirement, and exclusions for employees, household members, or past winners.
- Look for entry limits such as one per person, household, email address, day, or social account. Save a record of entries you plan to repeat.
- Check the deadline and time zone. A sponsor may use Eastern Time, another U.S. time zone, or its own local time.
- Read the prize details: approximate retail value, delivery limits, travel dates, taxes, substitutions, affidavits, and any pickup requirement.
- Do not pay a fee, buy gift cards, send a deposit, or share bank or card details to claim a prize. The Federal Trade Commission’s prize-scam guidance identifies those requests as scam signs.
Maryland Consumer and Tax Considerations
A real prize can still have tax consequences. The IRS says prizes and awards are generally taxable income and that noncash prizes are generally reported at their fair market value. Maryland has separate rules for wagering and gambling winnings, including Maryland Lottery prizes.
